Convicts can choose Senior Advocates as legal aid counsel at Supreme Court: Justice Surya Kant

Justice Surya Kant, the Chairman of the Supreme Court Legal Services Committee (SCLSC), has initiated a significant move to enhance legal aid for prisoners. According to recent developments, convicts can choose Senior Advocates as their legal aid counsel at the Supreme Court. This initiative allows convicts to select from a panel of leading Senior Advocates who are willing to provide pro bono services, giving them more autonomy in their legal representation.

Here are some key points about this initiative and the process of legal aid in the Supreme Court:

Legal Aid Process: To receive legal aid, applicants must meet the criteria under Section 12 of the National Legal Services Authority Act, 1987. Their applications are scrutinized by a screening committee, which includes Senior Advocates. If the case is deemed fit, legal aid is granted, and a panel advocate is assigned.

Senior Advocates: Senior Advocates are designated by the Supreme Court or High Courts based on their standing, ability, and experience. They enjoy the right to pre-audience and are often involved in significant cases.

Justice Surya Kant’s Initiative: Justice Kant has been spearheading a campaign to identify prisoners needing legal assistance. Over 5,200 prisoners have been identified, and efforts are being made to expedite the filing of Special Leave Petitions (SLPs) in the Supreme Court. The initiative aims to ensure that legal services are available to inmates from the beginning of their incarceration.
