Supreme Court Directs All High Courts To Monitor Compliance Of Stray Dog Management Orders, Says Erring Officials Will Face Contempt

The Supreme Court has recently directed all High Courts to actively monitor compliance with its orders on stray dog management, making it clear that erring officials may face contempt proceedings for non‑compliance.

What the Supreme Court has ordered

  • The Court has cast the High Courts in the role of “monitoring tribunals” for continued implementation of stray‑dog directions, treating compliance as a continuing mandamus.

  • Each High Court is to register suo motu writ petitions to track whether the Animal Birth Control (ABC) Rules, 2023 and earlier stray‑dog directions are being followed in its jurisdiction.

Role of High Courts and officials

  • The concerned High Court benches are to expand or tailor the monitoring mechanism as needed, but without diluting the core intent of the Supreme Court’s directions.

  • The Court has explicitly stated that jurisdictional courts (including High Courts) may initiate contempt or other appropriate action against officers who show inaction, willful disregard, or malafide implementation of the orders.

Protections for bonafide action

  • The Supreme Court has also cautioned that no routine criminal proceedings (such as FIRs) should be initiated against officials who act in good faith and in bona fide implementation of the directions.
